Cancellations / Transfer of Tickets / Refund if initiated by the participant will not be allwoed and permitted. Any requests received will not be eligible for a refund, under any circumstances.

In case of occurrence of any unforeseeable circumstances / events / situations (even force majeure) due to any x-factor leading up to event cancellation, the event fees paid would be refunded after deducting the relevant taxes and service charges. This cancellation decision will be taken up by the organisers.

DISCLAIMER TO THE EVENT

By agreeing to this disclaimer, i agree to abide by rules of Kalimpong Marathon conducted on 5-6 November, 2022 and i understand that it is my responsibility to take care of myself while running.
 
I understand that participating in this event is potentially hazardous, and that i should not enter and participate unless i am medically fit and properly trained. Any health problems or fatal cases such as death causing accidents or even death before, during or after the event, the organizers, sponsors, promoters, event location owners and each of their agents, representatives successors and assigns, and all other persons and entities associated either directly or indirectly with the event, will not be responsible at all.
 
In consideration of the acceptance of this entry, i resume full responsibility of any injury or accident that may occur while i am travelling to the event or while coming back from the event, or while i am on the premises of the event. I am also aware of and assume all risks associated with participating in this event, including, but not limited to falling with other participants, the effects of weather, traffic and conditions of the road or any – x factor affecting my own health.
 
I, for myself and my heirs and executors, hereby waive, release and forever discharge the event organizers, sponsors, promoters and each of their agents, representatives successors and assigns, and all other persons and entities associated either directly or indirectly with the event from all claims demands, costs, expanses, proceedings, arising of my participation in the event and i here by indemnify them against all liability, including, but not limited to liability for and in respect of all injury, death, loss or damage, arising out of my participation in the event.
 
If i am injured or taken ill or otherwise suffer any detriment, whatsoever, I hereby irrevocably authorize the event officials and organisers, at my risk and cost, to transport me to a medical facility and or to administer emergency medical treatment and i waive all claims that might result from such transport and or treatment or delay or deficiency there in and shall pay or reimburse to you all my medical and emergency expanses and here by authorise you to incur the same and shall provide to race officials such medical data relating to me as they may request. I agree that nothing here in shall oblige the event officials or organisers or any person to incur any expanses or to provide any transport or treatment.
 
I unequivocally give permission, unless i confirm otherwise in writing to event organisers, for my personal information and details to be forwarded for the purpose of the event administration and further permit my name, personal information quotes and photographic likeness in still photography or video to be used for the marketing and promotional purposes of the event and to other stakeholders, if required.
 
If the rule of law prevents any of the above paragraphs or any part of it to be unenforceable then it shall be constructed so as to give the maximum possible protection to all persons and entities associated directly or indirectly with the event.
 
I, all in all agree to the event’s cancellation & withdrawal policy as per mentioned on the event website & related pages.
 
I understand that correct and fully filling the address (in case, if required) shall enable the organisers to ensure delivery of the parcel within time (if applicable).
 
Participant’s successful signing up for an event whether online or offline, is his / her acceptance to this disclaimer too.

I understand that as & when I sign up for an event, I agree for all the above and hereby agree to the event’s terms and conditions.
