AROUND BIG CITIES (ABC)
TERMS
& CONDITIONS AND PARTICIPANT POLICY
By registering for, paying for, attending, participating
in, or using any ticket, pass, membership, or booking for an event organized by
Around Big Cities (ABC), you acknowledge that you have read, understood,
accepted, and agreed to the following Terms & Conditions.
1.
GENERAL
1.1 Participation in any ABC event is voluntary and at the
participant's own risk.
1.2 ABC reserves the right to refuse admission,
participation, or continued attendance to any person without assigning a
reason.
1.3 ABC reserves the right to modify, reschedule, reroute,
postpone, or cancel any event due to operational requirements, safety concerns,
weather conditions, government regulations, natural calamities, insufficient
registrations, or any unforeseen circumstances.
1.4 Event itineraries, schedules, routes, meeting points,
and inclusions are indicative and may change without prior notice.
2.
FITNESS & ELIGIBILITY
2.1 Participants are responsible for assessing their own
physical fitness and suitability before registering.
2.2 Participants must disclose any medical conditions,
injuries, allergies, or limitations that may affect their participation.
2.3 ABC reserves the right to deny participation to any
individual who appears medically unfit, physically incapable, or whose
participation may endanger themselves or others.
2.4 Parents or guardians are solely responsible for the
safety, supervision, and conduct of minors accompanying them.
3.
ASSUMPTION OF RISK
3.1 Outdoor activities involve inherent risks including but
not limited to:
• Slips, trips, falls, and injuries
• Uneven terrain and steep climbs
• Wildlife encounters
• Weather-related risks
• Road travel risks
• Dehydration, exhaustion, or illness
• Natural hazards
3.2 Participants voluntarily assume all risks associated
with participation and release ABC, its organizers, volunteers, trek leaders,
representatives, and partners from liability arising from such participation.
4.
SAFETY & CONDUCT
4.1 Participants must follow instructions issued by trek
leaders, event coordinators, local authorities, forest officials, and emergency
personnel.
4.2 Participants must respect fellow participants, local
communities, wildlife, heritage structures, and the environment.
4.3 The following are strictly prohibited:
• Possession or consumption of illegal drugs or narcotics
• Possession of weapons or hazardous materials
• Harassment, discrimination, abusive behaviour, or misconduct
• Damage to public or private property
• Littering or environmental damage
4.4 ABC reserves the right to remove any participant
violating these rules without refund.
5.
TRANSPORTATION
5.1 Transportation arranged by ABC is provided as a
convenience and is subject to availability.
5.2 ABC shall not be responsible for delays caused by
traffic, road conditions, breakdowns, weather, strikes, or other circumstances
beyond its control.
5.3 Participants using their own vehicles are solely
responsible for their driving, vehicle condition, insurance, fuel, permits, and
compliance with applicable laws.
6.
WEATHER & FORCE MAJEURE
6.1 Events may proceed in rain, wind, fog, or other weather
conditions unless deemed unsafe.
6.2 ABC reserves the right to alter routes, activities,
schedules, or destinations for safety reasons.
6.3 No compensation shall be payable for modifications
resulting from weather, government orders, natural disasters, pandemics,
strikes, road closures, forest restrictions, or other force majeure events.
7.
CANCELLATION & REFUNDS
7.1 Registration fees are generally non-refundable unless
expressly stated otherwise.
7.2 If a participant cancels:
• More than 7 days before the event – transfer may be
considered at ABC's discretion.
• Less than 7 days before the event – no refund.
• No-show on event day – no refund.
7.3 If ABC cancels an event before commencement,
participants may be offered:
• A refund of the event fee; or
• A transfer to a future event.
The choice shall be at ABC's discretion.
7.4 Processing fees, platform fees, taxes, payment gateway
charges, and third-party booking charges may be non-refundable.
7.5 Event registrations, tickets, bookings, and memberships
are non-transferable unless expressly approved in writing by ABC.
7.6 Requests for participant substitution or transfer may
be considered at ABC's sole discretion, subject to operational feasibility,
safety requirements, participant eligibility, and sufficient notice before the
event.
7.7 ABC reserves the right to refuse any transfer request
without assigning a reason.
8.
PHOTOGRAPHY & MEDIA CONSENT
8.1 Participants grant ABC the right to photograph, film,
record, and use their image, voice, likeness, and participation for
promotional, marketing, social media, website, advertising, and community
purposes.
8.2 Participants waive any right to compensation arising
from such usage.
8.3 Participants who do not wish to appear in photographs
or videos must inform the organizers before the event begins.
9.
PERSONAL BELONGINGS
9.1 Participants are responsible for their own belongings.
9.2 ABC shall not be liable for loss, theft, damage, or
misplacement of personal property.
10.
HEALTH & COMMUNICABLE DISEASES
10.1 Participants voluntarily assume all risks relating to
communicable diseases, infections, illnesses, or health conditions that may
arise before, during, or after participation.
10.2 Participants should refrain from attending if they are
unwell or suffering from any contagious illness.
11.
MEMBERSHIP & COMMUNITY
11.1 Membership in the ABC Adventure Community does not
guarantee participation in any specific event.
11.2 Community memberships are non-transferable and subject
to community guidelines.
11.3 ABC reserves the right to suspend or terminate
membership for misconduct.
12.
PRIVACY
12.1 ABC may collect participant information including
name, email address, phone number, emergency contact details, photographs, and
payment information for operational, communication, safety, and marketing
purposes.
12.2 Information will be handled responsibly and used only
for legitimate business and community purposes.
13.
LIMITATION OF LIABILITY
13.1 To the fullest extent permitted by law, ABC, its
founders, organizers, volunteers, trek leaders, representatives, affiliates,
and partners shall not be liable for any injury, illness, loss, damage,
accident, delay, inconvenience, expense, death, or consequential loss arising
from participation in any event.
13.2 Participants agree that any liability of ABC shall be
limited to the amount paid by the participant for the specific event.
14.
GOVERNING LAW
14.1 These Terms & Conditions shall be governed by and
construed in accordance with the laws of India.
14.2 Any disputes arising out of participation in ABC
events shall be subject to the exclusive jurisdiction of the courts of
Bengaluru, Karnataka.
15.
ACCEPTANCE
By registering, booking, paying for, attending, or
participating in any ABC event, you confirm that you have read, understood, and
agreed to these Terms & Conditions in full.
